DESCRIPTION:CPD Seminar | Residential Tenancy Act: Issues & Challenges \nWorkshop Overview : \nIn Malaysia\, there is currently no explicit legislation that provides a legal framework for regulating the relationship between landlords and tenants\, whether of residential\, commercial\, or industrial properties. The legal obligations and rights of the landlord and tenant are spelled out in a tenancy agreement entered into between the two parties\, which is normally written but sometimes oral. In the event of a disagreement\, common law\, case law\, contract law\, and appropriate legislation controlling distress and the eviction procedure are used. \nSpecific acts governing the legal relationship between landlords and tenants exist in other countries such as the United Kingdom\, Australia\, New Zealand\, and Canada and provides some level of protection to both landlords and tenants\, and the Malaysian government has determined that similar legislation is required. The roadmap for the Residential Tenancy Act (RTA)\, which would provide the legislative framework to govern interactions between property owners and their tenants\, was established during the tenure of the former Housing Minister. \nHowever\, many parties have raised several contentions to the proposed Residential Tenancy Act (RTA). One of our major issues is the appointment of a Comptroller of Residential Tenancies\, who will be authorized to manage security deposits on behalf of a neutral body. DESCRIPTION:Workshop Overview \nIn Malaysia\, there is currently no explicit legislation that provides a legal framework for regulating the relationship between landlords and tenants\, whether of residential\, commercial\, or industrial properties. The legal obligations and rights of the landlord and tenant are spelled out in a tenancy agreement entered into between the two parties\, which is normally written but sometimes oral. In the event of a disagreement\, common law\, case law\, civil law\, contract law\, and appropriate legislation controlling distress and the eviction procedure are used. \nHowever\, many parties have raised several contentions to the proposed Residential Tenancy Act (RTA). One of the major issues is the appointment of a Comptroller of Residential Tenancies\, who will be authorized to manage security deposits on behalf of a neutral body. This webinar is intended to provide and address potential concerns and challenges with Malaysia’s proposed Residential Tenancy Act (Act). \nLearning Outcomes\n1.
